Work Permit for Spain

WORKING PERMIT REQUIREMENTS

We are facing a temporary residence and employment authorization that is initiated by the employer / employee to hire a foreign worker who does not reside in Spain. The authorization will last 1 year and is limited to a geographical area and a specific occupation.

REQUIREMENTS

• Not to be a citizen of the EU, economic area or Switzerland, nor those that are applicable to them by the community regime
• Not be irregularly in Spanish territory
• Lack of a criminal record in Spain and in the previous countries of residence of the last 5 years.
• Not be prohibited from entering Spain
• Not being in the voluntary period of no return to Spain.
• Having paid the corresponding processing fee

Regarding the company, it is necessary that it meets some requirements between them:

• The employer submits an employment contract signed by the worker and by himself and that guarantees the worker an ongoing activity.
• That the employer is enrolled in Social Security and is aware of its obligations to it and the tax agency bureau.
• The employer has sufficient financial, for its business project.

Place of presentation: Immigration office of the province where the services will be provided by the worker.

In the event that the company has more than 500 workers and work centers in more than one province, the application will be submitted to the Large Companies Unit of the General Directorate of Immigration.

Since the work authorization is granted, the worker has 1 month to personally apply for a visa at the Spanish embassy or consular office corresponding to his or her address in his or her country of origin accompanied by the corresponding documentation.
