Securing Your EU Family Member Residence Card in Spain

Who can apply for it?

The relatives of a Spanish citizen or of another European Union member country or belonging to the agreement on the European Economic Area or Switzerland.

Family members

  • Spouse of the resident, provided that the agreement or the declaration of nullity of the marriage bond, or divorce, has not relapsed, and that the marriage has not been celebrated in fraud of law.

 

  • The de facto partner, with whom you have a union analogous to the conjugal registered in a public registry established for this purpose in a member state of the European Union, Iceland, Liechtenstein, Norway or Switzerland. As long as the registration is not canceled.
     
  • Children of the citizen of the Union or those of their spouse or registered domestic partner (as long as they are not legally separated) under the age of 21 or over that age as long as they live at their own expense, or incapable.
     
  • Direct ancestors and those of your spouse or registered partner when in your care.
     
  • Any member of the family who is in charge of the Union citizen in the country of origin.
     
  • Any member of the family who lives with the Union citizen in the country of origin. 

 

  • Coexistence will be understood as accredited if a continuous coexistence of 24 months in the country of origin is reliably demonstrated
     
  • Any member of the family, that for serious health or disability reasons is strictly necessary for the citizen of the Union to take care of personal care.

  • The spouse (after marriage)
     
  • The registered civil partner
     
  • Children under 21 years of age
     
  • Children over 21 years of age who are under the care of the EU citizen
     
  • Dependent parents (ascendants)
     
  • Partner in a relationship analogous to marriage (not registered)
     
  • Partner with whom you have a child in common
