SPANISH NATIONALITY BY RESIDENCE
This is about the possibility of obtaining Spanish Nationality with the condition of having resided legally and continuously in Spain immediately prior to the petition:
- 10 years of legal residence in Spain for the general case.
- 5 years of legal residence in Spain for people who have obtained the status of REFUGEE.
- 2 years of legal residence in Spain for nationals of origin of Latin American countries (Argentina, Bolivia, Brazil, Chile, Colombia, Costa Rica, Cuba, Ecuador, El Salvador, Guatemala, Honduras, Mexico, Nicaragua, Panama, Paraguay, Peru, Puerto Rico, Dominican Republic, Uruguay and Venezuela), Andorra, Philippines, Equatorial Guinera and Portugal.
- 1 year of legal residence in Spain for:
- Thouse who has been Born in Spanish territories
- Those who have duly exercised the right to opt.
- The one who has been subject to guardianship, guardianship or foster care of Spanish for two years.
- The one MARRIED with Spanish citizen for 1 year, not legally or in fact separated.
- The widower or widow of Spanish or Spanish, if there is no legal or de facto separation at the death of the spouse.
- The one born outside Spain of a father or mother, grandfather or grandmother, who originally would have been Spanish.
2.- BY ORIGIN
They are Spanish of origin:
- Those born from a Spanish father or mother.
- Those born in Spain of foreign parents if at least one of them would also have been born in Spain. The children of diplomatic or consular officials accredited in Spain are excepted.
- Those born in Spain of foreign parents, if both does not have nationality or if the legislation of either of them attributes a nationality to the child.
- Those born in Spain whose affiliation was not determined. For these purposes, minors born in Spanish territory are presumed born in Spanish territory
3.- BY OPTION
The faculty that the foreigner has that meets certain requirements to acquire Spanish nationality through a declaration of will.
- People who are or have been subject to the parental rights of a Spaniard.
- Those whose father or mother had originally been Spanish and born in Spain.
- Those whose determination of their affiliation or birth in Spain occurs after 18 years of age.
- Those that have been adopted by Spaniards being over 18 years.
