FAMILY REUNION

Are you planning to bring your family members to Spain through a family reunification visa? The process can be complex, because it involves different regimes, eligibility criteria and legal requirements. At TA LAWYERS, we specialise in providing comprehensive legal assistance for family reunion visa in Spain. Our team of experienced lawyers is here to guide you through the whole process, making it as smooth and stress-free as possible.

The first thing we have to take into account is whether it is a family reunification under the General or Community Regime.

General Regime: Your path to a family reunification visa

The application for a Spain family VISA may be submitted when the foreigner who is reuniting has authorisation to reside in Spain for at least one year and has applied for authorisation to reside for at least another year. Except for long-term residency.

Family members, you may bring to Spain

  • a) Your spouse, as long as you are not separated in fact or in law and the marriage has not been celebrated in fraud of law. It is not included when you can regroup more than one spouse, although the personal law of the foreigner admits this type of marriage.
  • b) Unmarried partner: This is the person who maintains a relationship analogous to that of a spouse with the applicant and:
  1. This relationship is registered in a public register established for this purpose, and this registration has not been cancelled.
  2. The validity of an unregistered relationship established prior to the start of the group's residence in Spain is established.
  • c) Their children or those of their spouse or common-law partner, including adopted children, provided that they are under 18 years of age at the time of the application for the residence permit in their favour or have a disability and are objectively unable to attend to their own needs due to their state of health.
  • d) Those legally represented by the applicant, provided that they are under eighteen years of age at the time of application for the residence authorisation in their favour or have a disability and are objectively unable to provide for their own needs due to their state of health.
  • e) Their first-degree ascendants, or those of their spouse or partner, when they are dependent on them, are over 65 years of age and there are reasons that justify the need to authorise their residence in Spain.

The foreigner who intends to regroup must meet a series of requirements, some of which include the following:

  • Not to be irregularly present in Spanish territory
  • Have financial resources to support the reunited family member.
  • Have adequate housing
  • Not have a criminal record in Spain
  • Have health care covered by Social Security or private insurance.
  • Be in possession of authorisation to reside in Spain for at least one year and have applied for authorisation to reside for at least another year
  •

How long does it take to obtain a family reunification visa in Spain?

The entire reunification process can take up to five months, depending on the workload of the Immigration and Consular Offices in each country. Once the application is approved, your family member is given one month to collect the visa and three months to travel to Spain.

What are the advantages of family reunification?

  • Strengthening family ties: Family reunification allows family members to come together and strengthen their bonds.
  • Emotional support: Having the family together provides a strong emotional support system. In times of personal hardship, it can make a big difference in the ability to cope with and overcome those challenges.
  • Support in education: Parents and other family members can provide support in children's education, which can have a positive impact on their academic performance.
  • Work-life balance: Family reunification allows for a more balanced distribution of family responsibilities, which can improve the quality of life for all members.
  • Promotion of cultural diversity: Family members may come from different places and cultures. This enriches cultural diversity in the family and can lead to greater open-mindedness and understanding of other cultures.
  • Contribution to the local economy: Increasing the demand for family-related goods and services such as larger houses, additional education and health care strengthens the local economy.
